Pay4Bay reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts or disrupts any of our services in any way.
If you use multiple logins for the purpose of disrupting the community you may have action taken against all of your accounts.
Submission of material
By submitting any material to us, you automatically grant Pay4Bay the royalty-free, perpetual, exclusive right and license to use, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, perform and display such material (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. You also acknowledge that Pay4Bay is not obliged to publish any material submitted by you on any Pay4Bay publication.

In certain circumstances Pay4Bay may also share your contribution with trusted third parties.

Failure to comply
If you fail to abide by these Community Rules you may be sent an email which informs you why your contribution has been refused or edited. This email will also include a warning that continuing to break the rules may result in action being taken against your account or accounts.

You may only register as a member if you can form a legally binding contract that is enforceable against you. For example, you must be older than or at 18 years old. By registering as a member, you warrant that you can form a legally binding contract.

When creating a User Id, you may not use a term that could be confused with someone else's trademark or brand (eg. NikeShoes), unless you have authority from the trademark owner;
Your Pay4Bay account, User ID, Password, Scores and Ratings, may not be transferred or sold to another party without our consent;

Post your contact information in any place except where particular contact information is requested;
Post contact information (including, without limitation, your website address) in your title, description and keywords fields;
Export or re-export any of our tools except in compliance with the export control laws of any relevant jurisdictions;
Take any action that may undermine the review, recommendation or ratings systems (such as displaying, importing or exporting reviews, recommendations and/or rating information to or from Pay4Bay.com or using them for purposes unrelated to Pay4Bay.com);
Distribute or post spam, unsolicited or bulk electronic communications, chain letters, or pyramid schemes;
Pay4Bay has the right to suspend or terminate your account without any compensation if you breached the User Agreement set out in this agreement; or
(by conviction, settlement, insurance or escrow investigation, or otherwise) engaged in fraudulent activity in connection with this Site.
As a user, you are welcome to put items up for sale in the Pay4Bay. We do have restrictions on what items you may sell, and what you may not sell. You may not sell illegal merchandise, including pirated software and music, firearms, adult images and videos, or anything that is affiliated with pornography, etc. Items that are up to bids are subject to review by the Pay4Bay, and may be removed without prior notice, if in violation with the User Agreement. Home page spotlight Items are picked by randomly on each refresh. If you selected home page featured or any location, your item will be displayed random on each refresh.
After subscribing to our website, you will receive an e-mail from us acknowledging that we have received your activation link and registration confirmation based on your activation. All registrations are subject to acceptance by us, and we will confirm such acceptance to you by sending you e-mail. The contract between us will only be formed when we send you this confirmation.
The seller assumes all responsibility for the contents of the listed items.
We are not responsible for any content posted to or distributed through our site.
Please note that in some cases, we accept orders as agents on behalf of third party sellers. The resulting legal contract is between you and that third party seller, and is subject to the Terms & Conditions of that third party seller, which they will advise you of directly. Great News! At Pay4Bay "No Listing Fees" and "No Final Value Fees" We do charge fees for list your items only if you list your items via outlet seller. Even for our outlet sellers will not be charged Final Value Fees. Only the listing fee will be charged which will be differ based on the level of the outlet. Any user can register on our site completely free of charge.
The price of any products or services will be as quoted on our site from time to time, except in cases of obvious error.
Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a confirmation.
Our site contains more than one product or services and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our listing procedures so that, where a product's correct price is less than our stated price, we will charge the lower amount when processing your order to you. If a product or services correct price are higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before processing, or reject your order and notify you of such rejection.
We are under no obligation to provide the services to you at the incorrect (lower) price, even after we have sent you a confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing.
Payment for all services must be paid with a valid payment method which we are offering on our channel. We accept payment with most listed credit and debit cards.
While any user can report a transaction up to 120 days after such transaction has been completed, the buyer is responsible for promptly reporting transactions to us by using their control panel, which is known as the "Resolution Centre"
The minimum transaction that a user can report is £1.00. A user cannot report, or provide feedback regarding, a purchase from a Cause or Association.
To report a transaction, a user must log into its account, click the "Payment Disputes" under the New Dispute of Resolution Centre tab, and input details of the transaction, including the paid invoice/receipt number and closing sale price amount of the transaction. The transaction will then be reported to the seller. Once the seller confirms the existence and accuracy of the reported transaction, the seller will be charged a fee as described in the "Advertising Fees for Seller" section below.
Sellers will have fifteen (15) days to accept or dispute a reported transaction. If the seller accepts the transaction by clicking on the "Agree and Pay Now" button, the fee owed will be charged to their credit/debit card(s) on file. If the seller disagrees with any portion of the reported transaction, the seller can click on the "Dispute" button and we will investigate the dispute. If the seller fails to take action on the transaction by not clicking on "Pay Now" or "Dispute" within fifteen (15) days of the reported transaction, the seller's ads will be removed, their Seller panel will be blocked, and we will notify the buyer via email that we have not received payment from the seller. In addition, if we do not receive any payment from the seller, we will be unable to issue any payment to the buyer's cause.
If a dispute arises between a buyer and a seller, the seller can utilize the "Dispute" feature to help resolve it. The buyer needs to provide proof of purchase if a seller initiates the dispute process. Each party will have fifteen (15) days to respond to any inquiry made by Pay4Bay.
During the dispute resolution process, either user can request that Pay4Bay review the dispute and any related documentation. If a user requests that Pay4Bay render a decision regarding a particular dispute and Pay4Bay does so, then such decision is final and binding upon both the buyer and the seller.
Each user to a dispute expressly agrees that any decision provided by Pay4Bay regarding a dispute will be binding upon such user, and further agrees that Pay4Bay will not be liable to such user for rendering and enforcing such decision.
If we find either user has misrepresented the facts regarding a given transaction or manipulated evidence in any way, that user's account may be permanently terminated.
We will not issue any refunds once a seller verifies a transaction reported by a buyer and clicks on the "Agree and Pay Now" button or the "Pay All Checked Items" button to initiate payment to us. By clicking the "Pay Now" button or "Pay All Checked Items" button, the seller is confirming that the transaction is final, and we will not thereafter issue any refunds to such seller, regardless of any agreement by or transaction between the seller and a buyer (including pursuant to which the seller refunds all or part of the purchase price paid by the buyer or in any circumstance where the buyer refuses to pay all or part of the purchase price to the seller).
If it is determined that a buyer and a seller are colluding to avoid reporting purchases to Pay4Bay, then their accounts will be terminated and we reserve the right to pursue all available legal recourse.
Please be advised that knowingly filing a false or inaccurate transaction report may subject the user to civil and criminal liability.
In order to post ads and sell products or services on Pay4Bay, sellers must provide and maintain on file with us a valid credit card or debit card number. We accept Visa, MasterCard, American Express, Discover, and any debit card.
All fees will be converted and paid in Great Britain Pound.
All invoices that the seller is required to pay are placed under the "Outstanding Payments" link located under the "Payment Account" menu. The seller can choose to select all due invoices and pay them all in one lump sum or one-at-a-time. However, each invoice must be paid within fifteen (15) days of the initial notification. If a seller does not pay within such fifteen (15) days period, all of the seller's ads will be inactive, their profile will be set to "inactive" and if applicable will be removed from our featured listings.
Late seller invoices will be charged a 10% penalty, and we may suspend the seller's account and send the invoice to a collection agency. Any fees charged by the collection agency will be added to the vendor's outstanding balance
If you send or receive text messages or if you make or accept phone calls, there may be fees charged to you by your phone company. Please check with your carrier to determine the applicable charges, if any. The user is solely responsible for any such fees/charges.
We warrant to you that any product or services purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied. Once again the seller assumes all responsibility for the contents of the listed items. We are not responsible for any content posted to or distributed through our site.
Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the product you purchased (and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us).
This does not include or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
We are not responsible for indirect losses which happen as a side effect of the main loss or damage (and which are not foreseeable by you and us), including but not limited to:
(a) loss of income or revenue;
(b) loss of business;
(c) loss of profits or contracts;
(d) loss of anticipated savings;
(e) loss of data;
(f) loss of data; or
(g) waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise (even if foreseeable).
Where you buy any product from a third party seller through our site, the seller's individual liability will be set out in the seller's Terms & Conditions.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control.
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
(a) Strikes, lock-outs or other industrial action.
(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
(e) Impossibility of the use of public or private telecommunications networks.
(f) The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.
If any of these Terms & Conditions or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
We have the right to revise and amend these Terms & Conditions from time to time (to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities).
You will be subject to the policies and Terms & Conditions in force at the time that you order product or services from us, unless any change to those policies or these Terms & Conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these Terms & Conditions before we send you the confirmation (in which case we have the right to assume that you have accepted the change to the Terms & Conditions, unless you notify us to the contrary within seven working days of receipt by you of the products).
